This study focuses on issues of elder abuse in residential settings. Violation of ethical principles is shown in the results of this quantitative study aimed at defining the extent, nature and causes of such abuse by employees’ unethical conduct towards clients in senior homes (i.e. residential nursing homes) in the Moravian-Silesian region of the Czech Republic. The research sample comprised 454 employees and 488 clients from 12 residential homes for older people. The data were collected from interviews with clients, who (...) also received a questionnaire concerning their satisfaction with the institution. Two questionnaires were administered to the employees, one based on a pilot qualitative study and a second to investigate burnout. Outcomes were assessed according to the extent and form of elder abuse, the causes of elder abuse and the violation of basic ethical principles. The responses, in particular those of employees, revealed both psychological and physical abuse of older clients, and thus violation of two basic principles: respect for the person and non-maleficence. The group at risk of elder abuse comprised aggressive and dissatisfied clients, as well as those with mental problems and dementia. The employees most at risk of being abusers were those who had been employed in institutional care for more than five years, had inadequate knowledge about social services and suffered from burnout. The prevention of elder abuse is recommended to be through education focused on ethical principles, increasing employees’ satisfaction by promoting a friendly and safe organizational culture, and providing adequate working conditions. Older people living in a residential setting have the right to respectful care based on professional ethics. The aim of this study was to describe employees' and clients' lived experiences of elder abuse. A qualitative phenomenological method was used with 26 employees and 20 residents from four homes for elderly people in the town of Ostrava, Czech Republic, and two managers from outside these institutions. All complaints about elder abuse (n 5 11) received by Ostrava Municipal Authority during the period (...) 2003 to 2007 were examined. Two main dimensions of the examined phenomenon were identified: forms of elder abuse and causes of elder abuse. Established forms of elder abuse were summarized as rights violation, financial abuse, psychological abuse, physical abuse and neglect. Causes of elder abuse included institution, employee and client characteristics. It is necessary in residential settings to create preventive policies that will focus on supervision regarding elderly people's rights violation and psychological and physical abuse, as well as on building organizational cultures that will respect ethical principles. Background Knowing the opinions of patients with Progressive Neurological Diseases and their family members on end-of-life care can help initiate communication and the drawing up of a care plan. The aim of this paper is to describe the creation and psychometric properties of the newly developed APND-EoLC questionnaire. Methods Following focus group discussion, four main areas of interest were identified: patients’ and family members’ attitudes towards end-of-life care, factors influencing decisions about treatment to prolong patients’ life, concerns and fears regarding (...) dying, and opinions on the system of care. The created questions were divided into domains based on factor analysis and psychometric properties were evaluated by sample of 209 patients with PND and 118 their family members. Results The final version of the scale contains a total of 28 questions divided into six domains and five individual questions determining views of the care system with specified response options. Construct validity was verified by confirmatory factor analysis for each evaluated area individually. Appropriate psychometric properties were identified in the questionnaire. Conclusions The APND-EoLC questionnaire can be recommended for use in both research and clinical practice. (shrink)

Brent Kious has recently attacked several arguments generally adduced to support anti-doping in sports, which are widely supported by the sports medicine fraternity, international sports federations, and international governments. We show that his attack does not succeed for a variety of reasons. First, it uses an overly inclusive definition of doping at odds with the WADA definition, which has global, if somewhat contentious, currency. Second, it seriously misconstrues the position it attacks, rendering the attack without force against a more balanced (...) construal of an anti-doping position. Third, it makes unwarranted appeals to matters Kious considers morally ‘clear’, while simultaneously attacking a position many others take to be equally morally ‘clear’, namely that of anti-doping. Such an inconsistency, attacking and appealing to the moral status quo as befits one’s argument, is not acceptable without further qualification. Fourth, his position suffers from a general methodological flaw of over-reliance upon argumentation by analogy. Moreover, it is argued that the analogies, being poorly selected and developed, fail to justify his conclusion that the anti-doping lobby lacks philosophical and moral authority for its stance. These issues are symptomatic of a more fundamental problem: any attempt at providing a blanket solution to the question of whether doping is morally acceptable or not is bound to run up against problems when applied to highly specific contexts. Thus, rather than reaching any particular conclusion for or against doping products or processes in this article, we conclude that an increased context-sensitivity will result in a more evenhanded appraisal of arguments on the matter. Over the past decade, a number of accounting and financial reporting frauds have led to lost stock wealth, destroyed public trust, and a worldwide recession that called for necessary reform. Regulatory responses and systemic reforms quickly followed, and we show that, while necessary, these reforms are insufficient. The purpose of this paper is to forward virtuous professionalism as a necessary path toward restoring financial reporting systems. We take the position of external observer and analyze the accounting profession over time to (...) assess what has transpired within our financial reporting systems. Our analysis reveals that the combined influence of commercialism and regulatory response has led to a systemic decline in accounting’s professional ideals and, as a result, an erosion of public trust. We then propose virtuous professionalism as a necessary process for restoring financial reporting systems based on sociological, professional, and philosophical theories. We argue that virtuous professionalism is necessary for restoring the public servant identity of the accounting professional. We conclude that efforts to restore financial reporting systems should begin with reforms that restore professional identity shaped by virtues. (shrink)

We discuss how the approach taken by regulators to address financial reporting issues has a significant influence on tone at the top. While tone must ultimately be established internally, regulators are more likely to have a positive impact on the quality of financial reporting by addressing organizational tone. A strong tone at the top should ensure that the financial reports are characterized by greater transparency and complete disclosures, and a regulator’s response will depend upon their perspective as to what motivates (...) management. A compliance-based approach, rooted in agency theory’s assumption that managers act in their own best interests, seeks to mandate desirable behavior through elevated monitoring and reduced managerial discretion. Alternatively, an empowerment-based approach rooted in stewardship theory views managers as trustworthy guardians and grants them greater discretion without burdensome external monitoring. In practice, regulations fall on a continuum between these two approaches. To illustrate the continuum between compliance and empowerment, we present three cases in financial and tax reporting and examine the outcomes of these recent regulatory responses. We then provide conclusions regarding the effectiveness of each regulation by considering how tone was influenced within organizations. (shrink)

In Canada, all institutions that conduct publicly funded, animal-based research are expected to comply with the standards of the Canadian Council on Animal Care (CCAC). The CCAC promotes the use of animal alternatives, and uses the “3Rs” principles of Replacement, Reduction, and Refinement as a guiding ethical framework. To ensure these standards are strictly enforced, internal ethics committees at each institution are tasked with creating “Animal Use Protocol” (AUP) forms to be filled out by researchers and evaluated by the committees. (...) In this paper, we assess AUP forms from Canada’s top research universities to identify the extent to which they conform to, or advance, the 3Rs framework. Our results show various deficiencies that call into question the quality of information elicited by these forms. To remedy this, we recommend that the CCAC assume responsibility for creating a standardized 3Rs section to be used on all AUP forms. In addition, proposal forms and experimental results for all research at CCAC-certified institutions should be digitized and uploaded into a national database. We argue that this would offer higher quality information for researchers at the experimental design stage, while strengthening the CCAC’s mandate to be accountable to the Canadian public. (shrink)

Whistle blowing programs have been central to numerous government, legislative, and regulatory reform efforts in recent years. To protect investors, corporate boards have instituted numerous measures to promote whistle blowing. Despite significant whistle blowing incentives, few individuals blow the whistle when presented with the opportunity. Instead, individuals often remain fallaciously silent and, in essence, become passive fraudsters themselves. Using the fraud triangle and models of moral behavior, we model and analyze fallacious silence and identify factors that may motivate an individual (...) to rationalize fallacious silence. We use a survey of graduate accounting students to test hypothesized factors that contribute to fallacious silence rationalizations in an academic setting. We find evidence that the ability to rationalize fallacious silence is related to community influences and personal traits such as awareness and moral competence. (shrink)

Colour shapes our world in profound, if sometimes subtle, ways. It helps us to classify, form opinions, and make aesthetic and emotional judgements. Colour operates in every culture as a symbol, a metaphor, and as part of an aesthetic system. Recent discussions among lawyers, philosophers, policy researchers and athletes have focused on the potential threat to privacy posed by the World Anti-Doping Agency’s (WADA) whereabouts requirements. These requirements demand, among other things, that all elite athletes file their whereabouts information for the subsequent quarter on a quarterly basis and comprise data for one hour of each day when the athlete will be available and accessible for no advance notice testing at a specified location of their choosing. Failure to file one’s (...) whereabouts, or the non-availability for testing at said location on three occasions within any 18-month period constitutes an anti-doping rule violation that is equivalent to testing positive to a banned substance, and may lead to a suspension of the athlete for a time period of between one and two years. We critically explore the extent to which WADA’s whereabouts requirements are in tension with existing legislation on privacy, with respect to UK athletes, who are simultaneously protected by UK domestic and EU law. Both UK domestic and EU law are subject to the European Convention on Human Rights (ECHR) Article 8, which establishes a right to “respect for private and family life, home and correspondence”. We critically discuss the centrality of the whereabouts requirements in relation to WADA’s aims, and the adoption and implementation of its whereabouts rules. We conclude that as WADA’s whereabouts requirements appear to be in breach of an elite athlete’s rights under European workers’ rights, health & safety and data protection law they are also, therefore, in conflict with Article 8 of the ECHR and the UK Human Rights Act 1998. We call for specific amendments that cater for the exceptional case of elite sports labour if the WADA requirements are to be considered legitimate. (shrink)

European political theorists have argued that contemporary imaginaries of climate change are symptomatic of a post-political condition. My aim in this essay is to consider what this analysis might mean for a feminist green politics and how those who believe in such a project might respond. Whereas much of the gender-focused scholarship on climate change is concerned with questions of differentiated vulnerabilities and gendered divisions of responsibility and risk, I want to interrogate the strategic, epistemological, and normative implications for ecological (...) feminism of a dominant, neoliberal climate change narrative that arguably has no political subject, casts Nature as a threat to be endured, and that replaces democratic public debate with expert administration and individual behavior change. What hope is there for counter-hegemonic political theories and social movements in times like these? I suggest that rather than give in and get on the crowded climate change bandwagon, an alternative response is to pursue a project of feminist ecological citizenship that blends resistance to hegemonic neoliberal discourses with a specifically feminist commitment to reclaiming democratic debate about social-environmental futures. Urban dwellers’ food and nutritional wellbeing are both dependent on infrastructure and can be indicative of wider wellbeing in urban contexts and societal health. This paper focuses on the multiple relationships that exist between food and infrastructure to provide a thorough theoretical and empirical grounding to urgent work on urban food security and nutrition in the context of rapid urban and nutrition transitions in the South. We argue that urban systems and food systems thinking have not been well aligned, but (...) that such alignment is not only timely and overdue but also fruitful for both thematic areas of research and policy. We draw in particular on work within wider urban political economy and political ecology that can be classified as part of the ‘infrastructural turn’ that is influential with urban studies but little acknowledged within food studies. Drawing on these literatures helps us to better understand the interrelationships between people, things and ideas that make up both infrastructure and food systems. Policy, planning and research relating to both food and urban systems cannot afford to ignore such interlinkages, though much policy still operates on the neat assumptions of progressive connectivity to ‘the grid’ and formal food retail. Instead we argue how in many urban governance systems, a variety of hybrid mechanisms—on and off the grid, public and private formal and informal—better represent how urban residents, particularly the most marginalised, meet their everyday food and infrastructural needs along a continuum of gridded and off-grid access. This article breaks fresh ground on the probabilistic problem of evil, contesting its first premise (probably, if God exists, gratuitous evil does not exist) instead of the commonly contested second premise (probably, gratuitous evil exists). In so doing, it presents a rehabilitated version of Leibniz’s argument for the irrelevance of gratuitous evil vis-à-vis the existence of God, according to which it is logically impossible for any world God might create to be devoid of pointless evil. Accordingly, my argument provides theists (...) a more fruitful strategy for dealing with evil than asking skeptics to deny their intuitive recognition of pointless suffering. (shrink)

In their recent contribution to this journal, Brian D. Earp, Anders Sandberg, and Julian Savulescu argue that "the 'medicalization of love' need not necessarily be problematic, on balance, but could plausibly be expected to have either good or bad consequences depending upon how it unfolds." Although I find myself in agreement with the majority of the points the authors make to this end, as well as with the general thrust of their position, I am nevertheless left feeling rather unsatisfied by (...) their overall exposition. This is largely because they fail to provide any substantial love-specific argument, as I demonstrate in this paper. (shrink)

In this radically revised intellectual portrait of Hegel and Marx that challenges standard interpretations of their political theory, David MacGregor considers the nature of the state in capitalist society. This is the first book to place Marx's and Hegel's political thought directly into social and historical context. Revealing the revolutionary content of Hegel's social theory and the Hegelian themes that underlie Marx's analysis of the English state in Capital, the author shows how the transformation of the Victorian state in (...) the nineteenth century influenced the mature Marx to reclaim Hegelian arguments he had earlier abandoned. These ideas included a theory of politics and social class that colored Marx's view of capitalist and working-class opposition to government reform initiatives. MacGregor criticizes interpretations of state action that present government solely as a tool of capitalist and patriarchal interests. Noting the essential significance of child labor in the growing industrialization during Hegel's and Marx's time, the author contends that "alienation," as the two philosophers understood the term, assumes a labor force in which many workers are socially powerless children and women. Given these conditions, the centrality of the English Factory Acts to workers' lives becomes obvious, a centrality acknowledged by Marx but forgotten by his followers. The author concludes his discussion with an assessment of current arguments about the state and civil society, relating these debates to Hegel's conception of the rational state. (shrink)

This paper focuses on compost use in overpasses and underpasses for wild animals over roads and other similar linear structures. In this context, good quality of compost may result in faster and more resistant vegetation cover during the year. Inter alia, this can be interpreted also as reduction of damage and saving lives. There are millions of tones of plant residue produced every day worldwide. These represent prospective business for manufacturers of compost additives called “accelerators”. The opinions of the sale (...) representatives’ with regards to other alternatives of biowaste utilization and their own products were reviewed. The robust analyzes of several “accelerated” composts revealed that the quality was generally low. Only two accelerated composts were somewhat similar in quality to the blank sample that was produced according to the traditional procedure. Overlaps between the interests of decision makers on future soil fertility were weighed against the preferences on short-term profit. Possible causes that allowed the boom of these underperforming products and the possible consequences are also discussed. Conclusions regarding the ethical concerns on how to run businesses with products whose profitability depends on weaknesses in the legal system and customer unawareness are to follow. (shrink)

Several philosophers and theologians have attempted to formulate monergistic, soft libertarian accounts of salvation. These accounts hold that the sinner has the ability to either resist or to do nothing at all with God’s universally given saving grace, in which latter case God will save her. However, I wonder with Cyr and Flummer whether these accounts go far enough because the nonresistant sinner voluntarily remains quiescent and is therefore arguably praiseworthy. I aim to remedy this alleged weakness by formulating a (...) possible account on which it never crosses the nonresistant sinner’s mind to resist, making her quiescence an involuntary omission. For all sinners whose minds it crosses to resist, they, on the proposed account, freely choose to resist. Combining Molinism with the scriptural notion of blaspheming against the Holy Spirit, I proceed to explain why it may cross the mind of some sinners and not others to resist. (shrink)
